On 18 October 2007 the European Court of Justice (ECJ) ruled that disability living allowance care component, attendance allowance and carer's allowance could be paid to people who moved from the UK to another country within the European Economic Area (EEA).
The Minister for Disabled People - Jonathan Shaw MP - has just made a written statement in the House of Commons regarding people who lost their entitlement to a disability benefit after they moved abroad.
If you lost entitlement to a disability benefit because you moved to another EEA state or Switzerland before the ECJ judgement on 18 October 2007 you will no longer be expected to meet the requirement to have been in the UK for 26 out of the previous 52 weeks when you left the UK. To benefit from this change, you must have moved abroad no earlier than 8 March 2001.
