""Income support and jobseeker's allowance payable if receiving NHS treatment abroad

From 4.10.04 people entitled to income support and Jobseeker’s Allowance can keep those benefits during a period of temporary absence from Great Britain to receive NHS hospital treatment under the National Health Service Act 1977 or National Health Service and Community Care Act 1990.

These acts only apply in England and Wales, not in Scotland. If anyone in Scotland reports a temporary absence abroad to receive NHS hospital treatment decision makers have been instructed to telephone Adjudication and Constitutional Issues Scotland (ACIS) for guidance.
